Godhra revisited after Nanavati Commissions disclosure

After six agonizing years of wait, it is not justice they seek. It is not restoration of their lives and compensation they seek. It is also not hope of passing sentence on the perpetrators of this most murderous of crimes, as also the thousands who actively aided the cause) in the name of a particular religion they profess). For the relatives and sympathizers of the scores of Hindu men, women and children either burnt to death or who survived with scars for life; what they have been awaiting is a nation"s appreciation of the gravity of the crime committed against them by jihadi terrorists sadly in cohorts with local Ghanchi Muslims of Godhra. The Nanavati commission report which was tabled in the Gujarat Assembly yesterday is perhaps the first progressive step in that direction after "secular" politicians, a judge, and progressive sections of the English media all combined in harmony to construct an accident out of the tragedy triggered by terrorism. Expectedly, this report has not gone down well too with their ilk and they have claimed it to be politically motivated; ironically the very fact they overlooked when Justice Banerjee presented his illegal report days before assembly elections in Bihar, where Laloo Prasad Yadav was precariously hanging onto hopes for surviving through his Muslim-Yadav votebank! But the larger question is not the vindication of the position of any party, individual or ideology in such a grievous tragedy; instead it is time we address the most fundamental question as to whether there was ever any doubt as to the origins of the same and why the secularists, whether politically, academically or in the media authorized this patently false script in their larger goal of defaming particular individuals and leaders of a particular political party, abuse an entire regional community which has contributed immensely to the Indian society, tarnish the very religion which in the words of Swami Vivekananda taught the world the principles of not mere tolerance but acceptance; all played by the secularist"s in their ultimate goal of conquering an ideology inimical to their interests overlooking the larger concerns of a nation whose faith in a section of its population had been more than shaken. Revisiting chronologically all these issues is vital if we are to understand what plagues Indian Secularism in its contest with so called communalists.

On the ill fated night of the 27th of Feb, 2002 59 Hindus including 26 women and 12 children were roasted to death in the S-6 coach of the Sabarmati express after it made an unscheduled stop at Godhra. This gory act was planned and executed by a select group of Islamic fundamentalists who ever since 9/11 were convinced that Allah"s apocalyptical hour of revenge against Christians, Jews and the idolatrous Hindus who were the worse of all creation had arrived. [1]

Why Godhra?

Godhra is not like any other ordinary city of India. It is known as "Mini Pakistan" [2] because of its highly dense Muslim population (close to 50%) Godhra has the dubious distinction of nurturing a large number of Muslim fundamentalists and jehadi elements. The local Muslims are not economically affluent either, yet this town had hosted three Islamic religious congregations Muslim representatives from more than hundred countries participated proving there has been a massive inflow of foreign money into Godhra in recent years. [3]

The plan of the conspirators of this dastardly deed was to burn the entire train carrying more than 2000 passengers, majority of whom were Hindu activists who were just returning from Ayodhya after petitioning the government for expediting construction of the Rama Temple at the disputed site at Ayodhya. Although, a Hindu backlash was to be expected consequent to the crime, these jihadis were confident that the spiritual gain would outweigh the material loss which anyway could be minimized by importing jehadi elements from other states as well as from Pakistan and Bangladesh. Moreover, their leftist friends in Human right groups, English news media, NGOs and minority commissions were expected to pressurize the government into submitting to their terms.

The local Muslim participation in the conspiracy

Godhra has been one of the hotbeds of communal violence ever since 1947. It has been witness to 15 riots in the past, most of which involved familiar causes, provocation by either community followed by retaliation. The secularists would blame the RSS for accentuating communal tension but as Praveen Swami of the communist weekly Frontline discovers[4] ; Godhra was actually an unusual place to attack the Hindu right because it has no presence there. Instead, he admits that one of the most fanatical Islamic fundamentalist groups, the Tablighi Jamaat being principally funded by the Wahabis of the Middle East had steadily gained power in Godhra and surrounding areas and established hegemony over other moderate Islamic groups by 2001. It ensured participation of the local Muslims in this conspiracy, without whose active support the scale of the massacre would have been not up to their expectations.

To convert sympathy into perfect co-operation on the day of the attack the core team spread rumours of a Muslim ghanchi girl being molested and the beard of a tea stall owner being pulled by the passengers of the train. According to eyewitness reports of contemporary newspaper accounts there is unanimity that a murderous 2000 strong Muslim mob attacked the train with stones, bricks, petrol soaked rags, swords and knives after certain jihadis cut the vacuum pipe of the train forcing it to come a halt. For instance, Mahant Devendradasji, the head priest of a temple in Ahmedabad, who was in the train, said: "A few people began stoning the train without any provocation. As a reaction, people inside the coaches downed shutters." The mahant said the attackers numbered over 2,000. [5] As one correspondent put it; "Shattered windowpanes and pieces of stones scattered inside the compartments bore testimony to the dastardly attack on the Sabarmati Express" [6] The investigations of the police showed that the miscreants had kept the petrol-soaked rags ready for use much before the train had arrived at the Godhra railway station. [7]

The Railway Police force present in the train provided another gory detail as to how "Provocative appeals like "kill the enemies of Osama Bin Laden" were made through a loudspeaker from a nearby Mosque" [8] Kanthibai Patel, a survivor remembers with horror rocks raining down on the roof and people outside shouting "Kill them! Cut them up!" He looked out and saw men with sticks attacking the train car. Patel used his handkerchief to bandage a woman wounded by rock. Then a burning rag was thrown in the train. The passengers doused that fire with water, he said. Then someone poured a flammable liquid into the car, and a burning torch. Within minutes, the coach was full of smoke. Passengers were choking. Outside, the mob was desperately trying to break open the doors, he informed [9] Kamala and Vijay (name changed) recorded their respective testimonies in the Tewaria Commission report had similar horrifying tales to narrate. [10] The former survived after being knocked unconsciousness by the fumes but lost both her parents and her two sisters accompanying her. The last thing she remembered was a murderous mob on the platform screaming "maro maro" (kill, kill) whom she saw equipped with swords and rods through a slit in the window even as the few local policemen vainly fired gunshots in the air to disperse them.

The diabolical mindset of one of the masterminds of this attack can be gauged from this telling testimony of Vijay Singh a fireman [11] who recorded that many more lives could have been saved if the fire engines were not delayed because of removal of the nut of the connection of the pipe with the water tank by Haji Bilal who was incidentally Congress member of the Godhra Nagarpalika, as also the chairman of its Vehicle committee who gained access to the firestation on the pretext of inspection for the past few nights prior to the carnage.

"Secular" Media"s perverse reaction

Sympathizing with the victims and expressing condolences to their families while demanding justice for the same should have been the norm, but it turned out to be at best, a rude exception. The reason we suspect was that any demand for bringing the perpetrators to trial would have been problematic for the secular media with its share of Muslim communalists especially in the context of the large number of local Muslims who were part of the pogrom apart from those who hatched this conspiracy, including those who spread rumours, attacked the train and launched vituperations through microphones from mosques.

Ajit Rana of the Statesman jeered the dead; "all the leaders seem to have forgotten that the bodies of the kar sevaks who died in Godhra are worth Rs 2 lakh each" was his only message of condolence. [12] Jyoti Punwari of the Hindu, another petty secular fundamentalist claimed on the authority of some anonymous Ghanchi Muslims, those very people who participated in the Hindu pogrom that "all eyewitnesses say the fire started inside the coach, it was a conspiracy aimed at creating a BJP wave after the party"s electoral defeats and decimating Muslims in the State." [13] Those who entertain such fiendish theories further justify the possibilities of legitimate Islamic reaction at the supposed excess of the kar sevaks who had molested an anonymous girl. How could a girl be molested in a coach with so many women and children is of course, beyond our comprehension. These English dailies found the reports of the mischievously vitriolic Urdu press which decries the recent Delhi police encounter as fake and the slain inspector M C Sharma to be a fake encounter specialist, creditable at that time. Ultimately, these theories of provocation are baseless when we consider the pre-planned nature of the event.

These secularists perfunctorily raised the bogey of discrepancies in the eyewitness accounts as reasons for their exclusion. This sophistry cannot withstand the fact that even a simple road accident"s account from the perception of multiple witnesses always provides a mixed picture despite the commonalities. It requires the ability of an intelligent investigator to derive and reconstruct the truth out of divergent and sometimes even conflicting accounts.

Riots or communal war?

Gujarat has been since its inception a communally sensitive state which actually highlights Gandhiji"s failed attempts in reconciling Hindu-Muslim differences. What happened is history but which was given a completely illegitimate character by secular spin doctors! Koenraad Elst, the Belgian Historian found obvious the conspicuous;

"In the analysis of communal violence, factual data were just as shamelessly replaced with invention, rumors and conspiracy theories. In this respect, religious extremists such as the Shahi Imam have behaved themselves better than the secularist campaigners who pose as the guardians of modernity and the scientific temper. Arundhati Roy risked the international fame she so clearly cherishes by going public with blatant lies about atrocities against named Gujarati Muslim women who turned out to be either non-existent or abroad at the time of the riots. Perhaps a fiction writer can afford this, but the news media with their deontology of accuracy and objectivity made themselves guilty of similar howlers. Internationally influential media like the Washington Post copied from an Islamist website rumors about Hindu provocations behind the Godhra carnage, falsely claiming a Gujarati journalist as source, and never publishing a correction when the journalist in question denied ever having put out such a story. With such media, who needs rumors?"

We may recall that in 1969, a communal riot engulfed the state in which 480 victims were Muslims, and only 24 Hindus. In contrast in 2002, the toll was 790 Muslims and 258 Hindus with around 300 missing [14] proving the former was a riot and the latter a communal war. These were the official figures released by the UPA government, yet the secular myth makers continue to repose faith in inflated figures to the extent of 2000 Muslims and do not reveal any Hindu victims at all. Such sophistry was to construct the case for a Muslim pogrom which was problematic when we take into account the high number of Hindu casualties, so early into the riots despite them being an overwhelming majority at over 92% population along with a seemingly sympathetic state administration to count upon. We should not forget in the heat of emotion that Muslims despite constituting less than 8% of the population of Gujarat state had inflicted heavy losses on Hindus and the ratio of Muslim: Hindu killed was only a little above 1:3. What made 40,000 Hindus rush to relief camps? Was it fear of mob violence, rape, arson and murder by Muslim fundamentalists? All evidence pointed to jihadi elements having infiltrated the state"s borders and further fueling tensions. Circumstances were so grave that it compelled local Congress leaders to participate in the riots ignoring their perennial votebanks [15] All in all, the Muslim contribution in the riots was equivalent to their Hindu counterparts, yet incredibly not a single secularist has ever demanded justice for the 250 odd Hindus killed in Godhra and the subsequent riots.

The state government was accused of looking the other way despite the fact that shoot at sight orders were issued the following morning, curfew imposed and the army called within 24 hours of the episode when Modi realized that things were getting out of control in the madness that had engulfed the people. Barely 53 hours after the incident, Army was conducting flag marches in the state and this to an extent controlled the situation. [16]

Another crucial aspect of the sociology of the riots often ignored is the class conflict in its origins. Apart from upper middle class Hindus, the other major participant of these riots were semi Hindu tribals. A delegation of these tribals told the Tewaria Committee that the Muslim moneylenders, shopkeepers and forest contractors have been exploiting them for decades. They charged exorbitant rate of interest to money loaned to tribals. In certain cases the rate of interest is as high as 50 per cent per year. Having got into this never-ending vicious circle of loans, the tribals have been reduced to the status of bounded labour. Tribals working as servants are ill-treated by these money lenders who happen to be Muslims. The accumulated anger of years of exploitation became explosive when moneylenders sexually exploited their womenfolk. The tribals are no longer allowed to use forest produce that has been their sustenance for centuries. This too fuelled the feelings of anger, hatred and revenge among them. [17] Ironically, the marxist intellectuals like Ashis Nandy surprisingly remain critical of their actions [18] which is absolutely at variance with their usual academic stance as in Mopilah in 1921 when the action of Muslim peasants murdering over 300 Hindus, while raping and converting most of their women was upgraded from the status of a Hindu pogrom into a peasant uprising.

Myth of Police Inaction

The police expected received the brunt of the abuse for not being able to protect the lives of the people. They had ostensibly sided with the Hindus it was alleged. Interestingly, in 1999, Vibhuti Narain Rai conducted a study at the behest of the Human rights commission and he discovered the policemen during riots harboured an anti Muslim mindset - they are convinced of the mischievous role of Muslims in riots and rarely entertain doubts regarding the modalities required to check them. The study found that at Meerut, Bombay, Allahabad and Ahmedabad the Muslim riot victims nurtured a deep distrust of the police because they were at the receiving end during house searches. [19]

Yet, the Gujarat police had fired 15,000 rounds of tear gas shells, 10,000 rounds of bullets, and killed more than 200 violent rioters in the state while arresting more than 18,000 Hindus and 3,800 Muslims. [20] The Nanavati Commission in a preliminary report as early as 2003 exonerated the police of any major lapse. [21] This of course is not to suggest that police lapses, sometimes intentional may never have taken place but they were predominantly because of the inherent limits of the Indian police operating under trying conditions and not out of any state-police nexus.

Towards constructing theories of genocide

Even before the BJP came to power, for almost a decade international and national secularists like Jaffrelot, Brass, Noorani, Engineer and others were hysterically howling against the appointment of a fascist government which would at its very inception throw open Muslim concentration camps. A four year BJP rule in absence of communal riots was not only proving dangerous to their academic credibility but slowly unearthing their professional lies. Godhra by itself was a boon to their fledging careers but it was still insufficient to fulfill BJP"s fascist prophecy since the massacre of a coach full of innocent Hindus by Muslims would certify as a grave provocation. The communist south Indian daily Hindu, slandered the victims of the Godhra carnage as untouchable kar sevaks, who had according to their (non existent) sources repeatedly abused and taunted Muslims at Godhra. A diabolical scheme of disparaging the dead was taking shape. But yet more required to be done to transform the event into a pogrom; to invent the scheme of Gujarat as the great lab and Godhra the grand experiment of ethnic cleansing which could be parroted for the next hundred years. The last barrier to this obnoxious and sick scheme was exonerating the Muslims of any hand in the train massacre. Muslim provocation was an incompatible ingredient while synthesizing the product of Islamic genocide.

Banerjee Committee report: Politically motivated or politically dictated?

Laloo Prasad Yadav became the secular messiah of India by fulfilling the secular prophecy of constructing a case for Muslim genocide in Gujarat by eliminating the last roadblock in the process, which was removal of the Muslim hand in the Godhra carnage. There was another profound political angle involved in his action. Laloo was certain to be voted out of backward Bihar with his corruption baggage of 15 years and this was his last gamble to polarize the Muslim-Yadav votebanks in his favour in the forthcoming assembly elections. The electorate however had different ideas!

Nevertheless, the damage had been done through the appointment of the Banerjee Committee which was declared illegal by both the Gujarat HC and the Supreme Court. [22] In a whirlwind investigation, Justice Banerjee came to the egregiously false and politically dictated conclusion that the fire was the result of an accident. The Muslim mob pelting stones and fiery rags at the train with the simultaneous train burning were explained as an unlucky coincidence by the proponent of this macabre theory! It is painful to realize that people can stoop so low in using a national tragedy to further their political ambitions. Unfortunately, this action only further buttressed the violent self righteousness of many an Indian Muslim who considers his community discriminated against and all police encounters as fake and no terrorist can be a Muslim and all bomb blasts to be the handiwork of the RSS to tarnish the image of Islam in India. Internationally, 9/11 for them stands for a Jewish conspiracy.

More seriously this tantamount to denial of justice to the victims. Survivors and relatives of those killed in the train attack reacted with outrage at the conclusion saying this flies in the face of evidence that they were not allowed to leave the coach and burning rags were thrown inside by a mob that had gathered at the station. [23]

The spurious sentence of Justice Banerjee was highlighted by a scribe; "Just what did Justice Banerjee do in Gujarat, and what did his interim report say? Crudely put, after visiting Godhra, Justice Banerjee sought to create a myth and then present it as evidence of truth. His report insisted there was no mob attack on coach S-6, ignoring eyewitness accounts of 1,000 people with stones and Molotov cocktails. Justice Banerjee ignored the Railway Protection Force (RPF) firing at the time - shots in the air to disperse rather than wound. He ignored the testimony of the RPF commandant who arrived after coach S-6 was set ablaze and ordered his men to fire at a mob that launched a second attack at about noon. Does Justice Banerjee know where these bullets are? Next, he ignored the 15 arrests made at the station itself; almost all of those arrested are still in prison. He ignored reports of an attempt to set fire to coach S-2, also crowded with Hindu activists. Does he believe coach S-2 too saw an accidental fire - two LPG cylinders, going off simultaneously, in a cosmic coincidence? Mr Banerjee is committing another illegality by repeating, "It"s an accident"". [24]

In summing up, Mr Banerjee wants us to believe that despite a 2000 strong mob armed with swords, rods and cocktails, despite flaming rags being thrown in multiple compartments, despite cutting off the vacuum tube of the train, despite murderous slogans having been aired from a mosque"s loudspeaker; the S-6 coach of the train imaginatively caught fire on its own!

The morally corrupt Academicians and the invention of a genocidal tradition

Scholars cutting across borders internalized the Banerjee committee report as gospel truth in their perennially pertinacious attempt to defame the Hindu right and paint a saint of every savage Jihadi. Ramachandra Guha in his recent book "India after Gandhi, 2006" first defends the carnage in Godhra through the secular cliché of Muslim provocation relying on those myths floated by the Urdu and communist dailies. Then he expresses doubt at the Muslim hand itself by invoking the dubious authority of Laloo"s committee. Ditto for Bipin Chandra who has been often suspected to be a Congress activist masquerading as a historian. In "India since independence 2E, 2007" the coach again caught fire on its own. Some prominent International scholars have fared no better. Barbara and Thomas Metcalf in their "Concise History of Modern India 2E, 2004" senselessly sideline any possibility of a Muslim role. Similarly, Christopher Jaffrelot, the hostile anti-Hindutva author vehemently denies any Muslim provocation in his essay "Communal Riots in India, State at Risk?, 2003"

What is conspicuous by its absence in all these similar narratives is a complete absence of the accounts of eyewitnesses, the survivors, police and critics of the Banerjee Committee report which displays a fundamental absence of the scientific method. More damning is the internalization of an illegitimate report sponsored by Laloo Prasad Yadav, a man who has a history of massive corruption and crime to his credit. They did not have the barest minimum of intellectual integrity to examine the credibility of a man like Laloo Prasad Yadav who now discovers the BJP communal but in the floor of the Indian parliament on 29th December 1989 he accused Rajiv Gandhi and the Congress of having engineered the Bhagalpur riots, the very party which is now for him the embodiment of secularism! [25] Today, he is the guardian angel of terrorist organizations like SIMI. He publicly expressed support, sympathy and defense for the same by claiming it to be a cultural organization; all out of this desire for consolidating his Muslim votebank. [26] To expect them to consider the politically motivated nature of the report would have been asking for too much.

According to president of Genocide watch, Gregory H Stanton there are eight stages of genocide. [27] The first two stages of classification and symbolization are irrelevant, as the Muslims themselves prefer these very same classifications when they are a minority in accordance with the dictum of the Quran and the Shariah. Polarization of Hindu-Muslim identities is a historical process and not a new phenomenon. Which leaves us with organization, preparation and extermination? Islamic fundamentalist organizations were in operation in Godhra but there was complete absence of any Hindu right presence; whether the latter consists of fundamentalist agencies is debatable. Of course, there has never been a denial that large scale loss of life and property occurred.

Finally, there is no scope for preparation of the process of genocide when the Muslims themselves launched a preplanned conspiracy of pogrom against Hindus in Godhra. As for extermination it requires active aid of the military and police, both of which were paradoxically involved in securing the lives and property of innocent Muslims to the best extent possible in the madness that had engulfed the people.
The final verdict is there for all to see: Godhra was not genocide.

Nanavati Commission report: dawn of the death of Pseudosecularism?

The Nanavati commission report [28] involved six years of conscientious research and investigation. Justice Nanavati is an ex-Supreme Court judge and his two man commission was sanctioned in 2002. In the past, he also probed the 1984 Sikh riots and incriminated certain Congress workers. Nanavati"s findings fairly resonate with the probe conducted by the Gujarat police apart from absolving the Modi administration of any misconduct. Two of the prime accused Salim Panwala and Farukh Bhana, are absconding and presumed to be in Pakistan. He also dismisses the theory of the attempted abduction of the mysterious Muslim girl which was nothing but a false rumour circulated as part of their alternative plan since the train was running late.

Not surprisingly the "secular" fundamentalists express doubt on the veracity of the report and claim it to be politically motivated. The insinuation is unwarranted for if it was to be the case its best electoral utilization would have just prior to the 2004 Lok Sabha polls. Perhaps, it would have served as a good antidote against the defamatory Tehelka tapes launched just prior the Gujarat Assembly elections last December? Politically, they serve no purpose this September when the electoral chart is barren. In contrast, we remind again the Banerjee Commission report framed within months and made public prior to the crucial Bihar Assembly polls. As for the Tehelka sting the doctored, frequently edited amateurish quality apart, its timing just a week before Gujarat assembly polls more than proves its political origin. That today Tehelka has become the English language mouthpiece of the terror organization SIMI [29] also points at its ideological background.

The findings of Nanavati Commission are consistent with all the canons of scientific methods of inquiry. The nation is satisfied at the findings which will be some consolation for the victims of the Godhra train carnage who were robbed of even their victimized identity by the criminally negligent Banerjee committee. Will this report enlighten our misguided "secular" zealots? In India, will it cause the Congress and the "secularist" media who had to eat humble pie in the 2007 Gujarat Assembly polls reasons to examine their policy of national subversion? Will it succeed in eradicating the cancer of pseudosecularism which is deep-rooted in the Congress and its ilk, that makes them genuflect shamelessly before the most criminal of Islamic fundamentalists, or are these people simply beyond redemption?
